Terms of Services (“Terms”)

Please read these Terms of Service ("Terms", "Terms of Service", "Terms of Use", "Terms of Services") carefully as it contains important information regarding your rights and obligations before using ShiftRide’s service ("us", "we", or "our").

ShiftRide (will also be referred to as ‘we’ or ‘our”, in this document), is an on-demand mobility platform that allows people to get access to car owners’ vehicles nearby.

ShiftRide Select (will also be referred to as ‘select’ or ‘subscription”, in this document), is a product of ShiftRide that provides long-term access to cars.

By using our service (“user”, "you", or "your") which includes, but is not limited to accessing our website, using our app, communicating with our users or staff either as a registered user or not you agree and are legally bound to comply with these Terms.


Changes

ShiftRide reserves the right to modify or replace these Terms at any time, at our sole discretion without prior notice and it’s the user’s responsibility to read them before using our service. By using our service you agree that you’ve read and understood our Terms of Services. If you do not agree with any of the points in this document, it’s your obligation to stop using ShiftRide’s service completely.



General Service Usage


Eligibility to Use Our Service

You must be at least 19 years of age or older to register and use our services on a limited bases.


Registration

Users are obligated to provide accurate information whenever they’re asked by ShiftRide’s services. ShiftRide reserves the right to perform background checks and/or other checks to verify the validity of the provided information.


Activity

You are responsible for any activity that occurs in your account and all those activities including, but not limited to bookings, remain valid whether you’ve authorized such activities or not. You hereby promise not to share your authentication information, such as email and password combination and/or social media credentials you use to login to ShiftRide services with others. We are not responsible for your failure to keep your account secure, or for any delay in terminating your account after you’ve reported unauthorized access to us.


Contact Information

ShiftRide will be contacting users through the contact information they’ve provided. Any failure to receive our notices does not invalidate our notices.


User Information

ShiftRide users should not follow, stalk, contact, and violate another user’s privacy. Also, users are obligated to notify us before using another user’s information for any other purpose than what is designated in the service.


Interaction with Other Users

ShiftRide users are obligated to not show any violating behaviour towards other users under any circumstances. Any issue or dispute which can’t be resolved between the two users should be reported immediately and directly to our customer support at support@shiftride.com.


Checking the Vehicle Condition Before Driving

ShiftRide users are required to carefully observe and identify any damages or issues found with vehicles before driving. In addition, you could capture video from all around the car to act as a proof in the case of a dispute between the user and the car owner in terms of the condition of the car before and after the usage period. Failure to document the condition of the car before using it, gives a total right to the car owner to blame the user for any damage or change in the condition of the car after the usage period. We also encourage our users to report any damage directly to the ShiftRide team through the mobile app or by sending an email to support@shiftride.com before using the vehicle.


Damages with the Vehicle

As per section “Checking the vehicle condition before driving” in this document (“Terms”), the user is responsible to confirm that there are no damages both inside and outside of the vehicle before the trip starts. As a user, you are responsible to report any damages to the ShiftRide team and have them verify the condition before you can drive the car. Failure to do so could result in fees placed on your account to repair damages.

If there is no sufficient evidence that the damage to the car has happened during a trip with ShiftRide, the car owner is fully responsible for the damage. If the car owner drives the car after damage is reported but not acknowledged and verified by a ShiftRide staff, the damage claim will be voided and the car owner will be fully responsible for the damage


Belongings Left in the Vehicle

ShiftRide accepts no liability regarding belongings left in the vehicle, and both users and car owners are responsible for the items they leave behind during and after their usage period. However, in these cases, we encourage our users and car owners to notify the ShiftRide team by sending an email to support@shiftride.com.


Sharing of Information

ShiftRide reserves the right to share, request, receive, use, and store users’ information at our sole discretion with other third parties for verification, obtaining additional information, or providing services that could potentially benefit ShiftRide’s community of users as a whole. You hereby give permission to ShiftRide to perform such actions.


Receiving Notices and Communications

It is solely your responsibility to receive notices and/or any communications sent from ShiftRide. In any event where the contact information you have provided us does not deliver our messages or notices, they will still remain valid. We may attempt to contact you in only one form of communication or more based on your information provided.


Violations

ShiftRide reserves the right, but not the obligation to investigate and prosecute the violators of their agreement (“Terms”).



User Specific Policies


Eligibility to Book and Use a Vehicle

You can only book and drive vehicles if you meet all of the following requirements:

  • You are at least 19 years of age or older; and
  • You have a personal Facebook account; and
  • You have a valid phone number that has not been associated with another ShiftRide account; and
  • You have a valid Driver's License of class G2 or G issued in Canada matching your Facebook account; and
  • You have a valid method of payment that is accepted in the application; and
  • You only have one (1) account with ShiftRide at all times; and
  • You have passed our internal and external driving and identity verification, which happens at the time of your first booking, each year, and/or periodically at any random time we choose; and
  • Have had no demerit points, tickets, and/or accidents in the past 3 years at the time of each booking.
We reserve the right to review your Facebook account and/or any submitted identification photos for legitimacy of identity. We may deny your eligibility to book and use the service at any time without any notice. No registration or license verification fees are refundable if you are found to be inelligble to use ShiftRide. If you are inelligible to use ShiftRide, you will NOT be provided insurance and continuing to use the service will put you at risk of being charged fees and being held responsibe for all costs related to your trip, including but not limited to any tickets, damages, and/or accidents.


Price Estimates Provided

ShiftRide provides price estimates through our mobile app and online based on your booking length of your booking. The price estimate provided is strictly based on the exact length of time. The actual price charged may differ based on your usage and any price surges or alterations happening at the time of your booking. Price estimates do not include taxes, promotions, discounts, and/or any fees that may be incurred related to fees in our “Fees section”.


Condition and State of Vehicles

ShiftRide does not guarantee that the vehicle information, listed features, and/or photos presented in the applications and websites to be accurate and/or true. We are not responsible for any discrepancies between the listing information of each vehicle and the vehicle itself. If you book a vehicle and realize that it holds significant dissimilarities between its listing information and the actual vehicle, please contact our support team and we will do our best to cancel your booking at no cost to you and ensure that the vehicle owner is aware of such dissimilarities.

If you book a vehicle that you believe has mechanical issues that make you uncomfortable or unsafe to drive, please report this to us immediately. Failing to report this to us at the start of your trip may result in voiding your ability to request any refunds for your booking fees and all fees will be charged accordingly.


Number of Accounts with Service

You must only have one account with ShiftRide at any point in time. Having more than one account could render you ineligible to continue your use of the service.


Purpose of Usage

You are expected to use the vehicles for personal use and must not use them for any commercial purpose such as ride-sharing, delivery, etc.


Vehicle Owner Specific Policies


Eligibility to List Your Vehicle

While sharing your vehicle does not impact your insurance, you must be the owner of the vehicle or be the primary lease or finance holder and have an appropriate personal or commercial insurance policy on your vehicle as required by law. This is required for ShiftRide to be able to provide insurance and the car owner must provide ShiftRide with proof of the insurance he/she is required to hold.


Address

Car owner agrees that if he/she is insured under ShiftRide’s insurance policy his/her address for service for documents from ShiftRide’s insurer will be ShiftRide’s mailing address and car owner waives any right to receive notice from ShiftRide’s insurer at any other address.


Car Listings

Car owners are only allowed to share their vehicle only if it meets all of the following requirements at the time of each booking:

  • The current market value of the vehicle is not more than $150,000; and

  • The vehicle is not more than 15 years old at the time of each booking; and

  • The vehicle has less than 250,000 kilometers at the time of each booking; and

  • The vehicle has at least 4 wheels, and seats no more than 8 passengers; and

  • Each seat in the vehicle must have a fully functional seatbelt; and

  • The vehicle has to be a private passenger type vehicle with a manufacturer’s gross vehicle weight rating of no more than 4500kg; and

  • The vehicle has passed any required emission tests; and

  • The vehicle is in a clean and safe condition to be driven by our users, which may be examined by ShiftRide from time to time without further notice; and

  • Have not received any complaints from ShiftRide users regarding its safety and/or condition, including but not limited to poor brakes, broken or cracked windshield, lose parts or pieces, broken headlights or tail lights, expired plate stickers, or simply any other reason that puts the customer at a risk of an accident, damages, or tickets.


Leased Cars

You are allowed to share your leased car on ShiftRide, however, we recommend you contact the original dealership, or review your lease agreement to make sure you’re legally allowed to do so. ShiftRide is not responsible in the case of personal contract violations. Usage from ShiftRide may result in extra kilometers on your car, however, we recommend setting your kilometer overage price such that you earn enough money to cover this expense.


ShiftRide Decals on the Vehicle

ShiftRide car owners are required to put ShiftRide window decals on their vehicle so that users can easily spot the car that’s being shared on our platform.


Wear and Tear

The car owner is responsible for natural wear and tear of the car. ShiftRide does not insure or cover the natural wear and tear, and we reserve the right, at our sole discretion to reject insurance or accept any liability in such cases. However, we still encourage our users to contact us at support@shiftride.com. Natural wear and tear includes but is not limited to scratches found on the rim, small scratches on the body of the car that are not clearly visible, small windshield cracks, mechanical parts such as brake pads, oil, and such.


Parking

The car owner is responsible for finding a suitable parking location to have their car parked while sharing with ShiftRide. Ideally, this location is where you already have 24/7 parking access to. This location must be accessible to the public and should not be in a private garage. In case you need help finding parking for your car, please contact ShiftRide team at support@shiftride.com.


Earnings and Pricing

When signing up, you are able to choose your own pricing or let ShiftRide automatically sets a price for your vehicle. Our automated price will depend on factors including but not limited to the current value of your vehicle, vehicle model, make, year, odometer reading. Pricing will be prorated in minutes and discounted at daily rates for users that book your vehicle hourly and is fixed for users that subscribe to your car for longer term. As a car owner, you earn 70% of each booking fee every month.


Starter Kit and Sign Up Fees

Upon signing up as a full-time car owner with ShiftRide, that is you are putting your car 24/7 on the system, a $88 fee + tax will be charged from your account for the Bouncie Tracking device provided, which is required to share with ShiftRide. This fee will only cover the device and a monthly tracking fee will also be deducted from your earnings based on our Fees Section.

Depending on the year of your car and/or the kilometers on the car, we may require you to perform a safety of your vehicle at your own cost and provide the documentation to us to confirm your car’s eligibility.


Vehicle Damage and Repairs

ShiftRide is not responsible for paying car owners for any damage to the car owner’s vehicle unless a responsible user has been identified and has accepted responsibility for the vehicle damage and repair costs. Car owners reserve the right to repair their car at their preferred location and send the receipt to ShiftRide via email at support@shiftride.com.

We will attempt to collect this payment from the customer and will reimburse you once the responsible user or collection agency in charge pays in full. If the repair cost is higher than the insurance deductible as listed in our “Fees section”, we will require to submit a claim through our partner insurance company.


Vehicle Key Handling and Storage

ShiftRide is not responsible for missing, damaged or removed lockboxes used to store keys by anyone, including but not limited to the property manager and owner. Vehicle owners are fully responsible for contacting the property manager or owner in regards to ShiftRide’s service and it's property before any commencing of the service.


Non-Booking Periods

ShiftRide is not responsible for any event, including but not limited to theft, damage, loss of keys for the vehicle when a vehicle is not in an active booking by a user on ShiftRide. Car owners are fully responsible for their vehicle during periods where the car is not booked.


Subscription Specific Policies


Vehicle Reservations

Users may reserve a car for a subscription to start at a future date based on the availability of the vehicle by paying a reservation fee outlined in the "Fees section" in this Terms. This fee counts towards the subscription deposit outlined in the "Deposits" section of this Terms and will not be refunded in case of a cancellation.


Deposits

Before starting a subscription, picking up the vehicle or getting access to our insurance for your subscription, we will require a $500 refundable deposit. This deposit will be returned back to you in full, unless you are found in violation of the "Checkup and Check Out" section in this Terms. Your deposit may be used as payment towards any outstanding fees in the “Fees section” in this Terms based on your subscription and account status.


Booking Requirements and Payments

You are expected to always maintain a valid method of payment on your account and subscribe to the minimum specified number of terms each time you create a new subscription. Payments will be charged to your credit card or your primary method of payment every 7 days until the subscription period is over.

If we fail to collect any outstanding payment on time or we find that you are in violation of any of the sections in this Terms, we may terminate your subscription and take measures to disable your access to the vehicle, including but not limited to repossession of the vehicle. A late payment fee may also be charged to your account based on the “Fees section” in this Terms.


Distance Allowances

Each vehicle has its own weekly kilometer limit and some vehicles have no limits at all. For every kilometer driven over this limit, set by your vehicle provider, your subscription will be subject to a fee based on the “Fees section” in this Terms at the time of renewal of your subscription.


Subscription Cancellation and Refund Policy

You may cancel your subscription at any time with a 48 hour notice. To do so, please contact us to coordinate your check out process. Subscriptions cancelled prior to their commencement are subejct to the "Reservation Fee" outlined in the "Fees section" of this Terms. Subscriptions cancelled before their minimum term, are subject to an early cancellation fee set by the vehicle owner. Also based on the "Checkup and Check Out Process" section in this Terms, you may be held responsible for fees to pay upon cancellation.

You must meet the minimum booking requirements explained in the "Booking Requirements and Payments" section of this Terms. If you cancel your subscription earlier than the minimum number of terms laid out in the "Booking Requirements and Payments" section of this Terms, insurance fees will still be charged up to 7 days after the cancellation.


Maintenance and Vehicle Condition

Before the end of each of your subscription terms, you are required to check in with your vehicle provider either digitally (through online video calls and chats) or by visiting the location set by your vehicle provider for a quick checkup. This is usually but not always the same location you picked up the vehicle from.

During this checkup, vehicle providers will review the condition of the vehicle, check distance driven, and help answer any questions or concerns you may have with your vehicle. Based on the "Checkup and Check Out Process" section in this Terms, you may be held responsible for fees to pay upon this MANDATORY checkup of your vehicle. YOU ARE NOT ALLOWED TO perform any modifications or have any sort of mechanical work or maintenance performed on the vehicle outside of the location requested by your vehicle provider unless you have written approval from the vehicle provider.

Vehicle providers of ShiftRide Select will provide routine maintenance as a service for the platform without any additional costs to you. We will be in touch with you when your routine maintenance is due to schedule a time if it falls outside of your routine checkups. You are required to visit the preferred location set by the provider of the vehicle you are using with your subscription at the time of your routine maintenance. It is a requirement for vehicle providers to keep the car in a well-maintained and safe-to-drive condition, including but not limited to having enough engine oil, having the proper winter tires during snowy or icy weather, and ensuring that all of the vehicles main mechanical components are performing as they should, meeting the regulatory standards in their jurisdiction. Failure to do so may result in a withheld of payments until the issues are resolved.

PLEASE NOTE: FAILURE TO PERFORM THIS MANDATORY CHECK UP OR ROUTINE MAINTENANCE WILL CAUSE IN ANY OR ALL OF: AUTOMATIC TERMINATION OF YOUR SUBSCRIPTION, YOUR DEPOSIT DEEMED NOT REFUNDABLE, TOWING AND/OR REPOSSESSION OF VEHICLE, AND/OR FURTHER FEES PLACED ON YOUR ACCOUNT. We will attempt to notify you via any or all contact method you've provided us by signing up to use our service. Failure to receive or respond to these notices does not invalidate our notices or the cancellation of your subscription.


Checkup and Check Out Process

When you are doing a checkup for your vehicle, or are done using the vehicle and want to cancel your subscription, the vehicle provider or ShiftRide personnel will complete a Checkup and Check Out Process, which is comprised of completing the checklist below. This will REQUIRE you to have the vehicle present at the location provided by your vehicle provider, unless you have arranged for a pick up by ShiftRide or the vehicle provider prior to your Checkup and Check Out Process. If any of the following fail the check, you will be responsible for fees applied based on the “Fees section” in this Terms.

  • The vehicle does not have excess wear and tear. Excess wear and tear includes but is not limited to dents and scratches larger than 3 inches in diameter.

  • The vehicle has not been modified in any way, including but not limited to mechanical or physical modifications.

  • The vehicle has not seen any mechanical damage due to improper driving patterns.

  • The vehicle has not been driven over the kilometer limit set on your subscription term based on the "Distance Allowances" section of this Terms.

  • Your rating or driving eligibility has not fallen outside of the requirements set by both ShiftRide and your vehicle provider. Your rating can include poor driving behaviour or dangerous driving patterns detected during your subscription.

  • There are no outstanding parking tickets, toll road fees, speeding and/or red light camera tickets on the vehicle received during and/or as a result of your subscription.

  • Your account is in good standing and you do not have any outstanding balances to be paid.

  • ONLY ON CANCELLATION

  • The vehicle is returned in a clean condition both in exterior and interior or at least equivalent to its condition at the start of the subscription.

  • The vehicle has an equivalent amount or more fuel than at the start of the subscription.


Vehicle Recalls

ShiftRide and/or Vehicle providers may require to recall vehicles on the ShiftRide Select at any point at our/their sole discretion whether it be for safety checks or otherwise, considering that a 24 hour notice has been given to ShiftRide and the customer currently subscribed to this vehicle. You are required to comply and return the vehicle back to the requested location within a 24-hour notice where your subscription will be renewed with another vehicle, canceled, or paused, at the sole discretion of ShiftRide.


Roadside assistance

Roadside assitance is not a service provided by ShiftRide. Subscriber is expected to either purchase one for the subscribed vehicle or use available services like CAA in case of an incident. If the car breakdown is identified by ShiftRide staff to be linked to the vehicle and not the subscriber, the vehicle provider may be held responsible for the extra fees.



Charges


Fees Section

ShiftRide reserves the right to remove, modify, or add any fees in the fees section of this document (“Terms”), at our sole discretion without any prior notice. In the case of any violations, the charged fees would reflect the information in this section (“fees section”) at the time of the occurrence.


Valid Payment Method

As a ShiftRide user, you are obligated to always have a valid payment method on your account. ShiftRide reserves the right to charge any valid payment method on your account until all the outstanding fees are covered at any time. We also reserve the right to employ all legal methods available to collect the outstanding amounts, including but not limited to sending your information to a collection agency. Collection fees will be applied to your outstanding balance as outlined in this section (“fees section”).


Time of Charge

ShiftRide reserves the right to charge partial amounts during any trip to ensure eligibility to continue bookings. If partial charges fail at any point in time while on a booking, you will have 2 hours to make funds available or update your primary payment information. Failure to do so could result in an automatic cancellation of your booking and a change in your eligibility. ShiftRide will require you to return the vehicle in its original condition immediately in such an event. Failure to do so could result in extra fees placed, including repossession costs for the vehicle. Police will be reported with vehicle theft and your information will be shared with authorities.


Charges on Account

You are obligated to pay all the fees as listed in our “Fees section”. ShiftRide reserves the right, at our sole discretion to charge appropriate fees when necessary.


Violation of Car Owner’s Instructions

As a ShiftRide user, you are obligated to follow the car owners’ instructions on how you’re allowed to use their car. Failure to do so can result in extra charges being applied to your account, and while these charges are based on the car owners’ report, in the case of a dispute, ShiftRide reserves the right to evaluate the situation and charge you the appropriate fees.


Tickets

ShiftRide users must report any tickets that they might have received during the usage period to the ShiftRide team at support@shiftride.com. The ShiftRide team makes sure that all the transactions are documented in the case of a dispute. The related charges will appear on the user’s account and must be paid with the booking fees.


Extra Charges Report

Only within 48 hours of the trip end, the car owners are able to request for extra charges based on the “Fees section” in this document (“Terms”). ShiftRide reserves the right, but not the obligation to ignore any request sent after that period. All requests should be sent to support@shiftride.com. Please include the booking number in your email so we can process it faster.


Car Owner Payout and Collection Fees

In the event that ShiftRide fails to collect payment from a user, your payout as a car owner will be delayed until we are paid by the customer or the collection agency involved if the payment is in the hands of a collection agency. Any collection fee accumulated during this period will be deducted from the car owner’s earnings in proportion to the division of revenue between all parties involved, including but not limited to ShiftRide and the car owner.


Fueling of Vehicles

All cars should have a full tank of gas at the start of the trip. If you pick up a vehicle with less than a full tank, please contact us via the chat in our app right away. Users are responsible to fully pay for and fill the gas level to FULL before returning the vehicle and ending their trip. ShiftRide is not responsible to provide a re-imbursement for gas. Users are required to ensure they put the correct gas type at the gas station when refueling the vehicle. We REQUIRE you to send us clear photos of the fuel levels at the beginning and at the end of your trip. Failure to follow this step properly will result in fees applied on your booking as laid out in this section (“fees section”).

Picking up a vehicle that has less than a full tank: We ask that you send us a clear photo of the fuel levels before starting to drive, when you pick up the car. We'll then re-imburse you with the amount of fuel missing. You are still required to pay for gas used during your trip and return the vehicle with a full tank of gas.

All car owners are responsible to share their vehicles with a full tank of gas. If a car is found to have less than a full tank of gas at the start of a trip due to an owner error, fees will be applied as laid out in this section (“fees section”).

NOTE: All the fees in the “fees section" are in Canadian dollars. These fees will be charged on your primary method of payment, unless alternative payment has been arranged, without any prior notice. An electronic receipt will be sent to the email address we have from you on file.

To ensure that you are eligible to pay for your ShiftRide bookings, we charge a pre-authorization before every booking.

Booking Deposit Fees
If your account has had issues before while booking and your rating has fallen below the standard, or it is your first time booking, we will charge a deposit which will be returned to you when you return the vehicle in the proper condition.

Poorly Maintained Vehicle Fees
If ShiftRide receives a poor rating from a customer who had to cancel their trip, or was not satisfied by their trip, due to mechanical issues with the vehicle, this fee will be deducted from your earnings or charged on your credit card.
$50 + cost of alternative transportation provided for customer on cancellation and possibility of a temporary or permanent termination of the ability to share the vehicle on ShiftRide
Missing Vehicle Documentation
If important documentation including registration and proof of insurance for the vehicle is missing from the vehicle. There will be this fee applied for every instant, aside from any violations issued by law enforcement or bylaw.

Lockbox Maintenance Fees
If you decide to have ShiftRide or one of its partners/car owners handle maintaining your car's lockbox, you will be subject to this fee from your earnings for the month.
5% of net earnings (after ShiftRide fees)
Device Tracking Fees
For cars shared on-demand with ShiftRide's tracking device, a monthly fee will be charged for the data and usage. Fee is subject to change based on provider's fees.

NOTE: If the car owner spends any money regarding tolls, fines, cleaning, etc. he/she should notify ShiftRide by sending a receipt to support@shiftride.com and ask for reimbursements where applicable.

Improper Use Fees

Toll Road Fees

Users are responsible for all the tickets and violations during, or as a result of, their trip.

Towing & Car Retrieval Fees
Users are solely responsible for all the towing and impounding fees during or after the car usage period.

Roadside Assistance Fees
In the case of any roadside event as a result of a “Terms of Services” violation, the user is responsible for extra charges and administrative fees.

Violation of owner’s policy (i.e. smoking in a car, bringing a pet in the car) can result in a fine for the offending member.

ShiftRide Select Fees

This is the fee if you choose to have ShiftRide or the vehicle provider deliver the vehicle to you or to pick it up at the time of checkup, cancelling your subscription, or swapping vehicles. Delivery may not always be available so please contact us to confirm.

Vehicle Modification Fees
This is the fee if you make any physical or mechanical modifications to the vehicle. Please remember that this is not allowed when using the service.

Refueling Fees
This is the fee to refuel the vehicle back to its original fuel level when the vehicle was handed off to you at the time of returning the vehicle when pausing your subscription, canceling, or swapping vehicles.

* The insurance is individual dependant and the minimum weekly insurance fee is $70.


Insurance

As part of ShiftRide service, we provide insurance to our users during the usage period. Before issuing the insurance, we require the user to answer basic questions regarding their past driving record, but we’re not obligated to do so. In the case of such questions, users are obligated to answer them accurately. Providing wrong information or withholding any critical information, including but not limited to accidents, and tickets invalidates your insurance.

If users already have insurance and would like to use that instead of the one we provide, the user must contact their insurance broker and make sure they are able to use their insurance with our service. The user is also responsible to notify us in advance regarding their personal insurance, so we can make the required arrangements. Failure to do so gives ShiftRide the right to charge the user for insurance automatically.

It’s important to note that insurance that might come with your credit card is unlikely to be applicable to ShiftRide’s services. However, we encourage our users to contact their credit card provider to verify their coverage.

User’s personal information may be disclosed as required to ShiftRide’s insurer and to any party that is directly involved in an insurance claim situation which involves or which the party reasonably believes involves the usage of a listed car on ShiftRide.

User agrees to notify ShiftRide of any damage or injury to any person or property sustained during the usage period as soon as possible after the damage or injury occurs and to keep ShiftRide notified of the status of such injury or damage claims.

ShiftRide’s insurance policy will provide users with insurance coverage in accordance with its own terms. This insurance Policy is independent of our Terms and is subject to its own terms, conditions and exclusions. VEHICLE OWNERS: You still require auto insurance on your vehicle and you are responsible to contact and notify your insurance company regarding sharing your car on ShiftRide, letting them know that ShiftRide provides insurance coverage during trips as well. Failure to do so can put you at risk and ShiftRide is not responsible for any consequences as a result of this.

During the car usage period, our commercial insurance policy provides the following coverage:

  • $2,000,000 Third Party Liability. Coverage includes personal liability for the user, third-party liability for the passengers, and third-party property damage as a result of an accident.

  • Standard Accident Benefits.

  • $1,000 Deductible for All Perils.

  • Up to $1,500 for transportation replacement.

  • No depreciation on new vehicles.



Driving to the United States

We’re currently operational in Canada, and specifically in Ontario. If you’re planning to drive to the United States of America, you require a different insurance policy. To provide you with the appropriate insurance and accurate pricing you are required to contact us in advance at support@shiftride.com and we’ll make sure you are fully equipped before going on a drive.


Disputes

In the case of a dispute, we encourage all of our users or parties involved to contact us before taking any legal actions so we can resolve the dispute in the best possible way.


Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.


Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our service, and supersede and replace any prior agreements we might have between us regarding the service.
